What do you need to know?
The exploitation authorisation grants its holder the right to make use of mineral deposits and other geological resources classified under Section A of the Mining Law, in accordance with the conditions of the authorisation granted.
The right to exploit Section A resources is directly linked to land ownership and belongs to:
- The landowner, when the resources are located on privately owned land.
- Where the resources are located on state, provincial, or municipal public property, the owners may exploit them directly or transfer their rights to others.
- Where they are located on public domain and for public use, they are subject to common use.
The exploitation authorisation is granted for a fixed period, which in no case may exceed the period for which the applicant can demonstrate a valid right over the land.
To natural or legal persons who meet the conditions to hold mining rights and who wish to exercise the right to exploit Section A resources under the Mining Law on land for which they can demonstrate a valid right of ownership or use.
