This is the permit an undertaking needs to provide public passenger transport, in vehicles with more than nine seats (bus).

This can only be done online. Documents provided via another channel will not be taken into account or considered for the purposes of the submission date.

Documentation

General information:
The Directorate-General for Transport and Mobility will obtain information on applicants from the Electronic Registers of the Directorate General for Traffic (DGT), the National Agency for Tax Administration (AEAT), the Social Security General Fund (TGSS), the National Statistical Institute (INE), the Register of Companies and other registers. This information is necessary to certify compliance with requirements for the granting, endorsement or amendment of licences that enable them to carry out the activities regulated in the Land Transport Organisation Law (LOTT) and in regulations issued for its implementation and development, unless they expressly deny authorisation for their consultation.

If applicants do not give their consent, they must attach a copy of the documents proving compliance with the established requirements to their application. Evidence that the documents are true copies of the originals will be provided by signing with an electronic ID card or with one of the electronic certificates recognised by the Open Administration Consortium of Catalonia. In accordance with the provisions of Article 28(7) of Law 39/2015, of 1 October 2015, on the Common Administrative Procedure of Public Administrations, applicants are responsible for the truth of the documents they submit.

Legal personality:
If the permit applicant is a limited Catalan cooperative company (SCCL), the articles of association registered in the General Register of Cooperatives must be provided.

Vehicles:

  • The vehicle data sheet must be provided for new vehicles pending registration.
  • If any of the vehicles are leased, the purpose of the vehicle must be indicated on the registration certificate as 'Public-Rental without driver'. The rental contract (or draft contract or vehicle delivery sheet) must include:
    • Identification of the hiring service provider (rental undertaking):
      • Natural person: name, NIF (tax identification number) and signature.
      • Legal person: name and NIF.
    • Identification of the hiring party (permit holder):
      • Natural person: name, NIF (tax identification number) and signature.
      • Legal person: name and NIF of the undertaking and name of the representative.
    • Identification of the vehicle by registration number or technical data sheet.
    • Duration of the contract.
    • Term of the contract: when submitting the application, the contract must be in force.

Financial capacity:
In order to provide evidence of the financial capacity of the undertaking, proof must be provided that the share capital is at least EUR 9 000, including reserves, when only one vehicle is used, and a further EUR 5 000 for each additional vehicle used (see the point on financial capacity in the requirements section).

If the applicant is a natural person:
Financial capacity can be proven by one of the following options:

  • None of the assigned vehicles owned or leased must be more than 12 years old. If any are held under an ordinary rental arrangement, this must be for a period of at least 24 months.
  • Stamped bank certificate showing the availability of funds related to:
  • Current accounts
  • Bank deposits

    The certificate must have been issued within the six months prior to its submission and it must specifically state the amount to which it relates. The certificate may determine the overall volume of resources or that the volume of resources exceeds a certain amount. In no case will general references such as the following be accepted: ‘...has sufficient resources to run a transport undertaking...’
  • Latest Personal Income Tax return or payment document.

If the applicant is a legal person:
If the data returned from an online search of the Register of Companies do not prove the necessary financial capacity, the following may be submitted:

  • Latest corporate income tax return and, if necessary, a certified copy of documents showing the capital increase after the corporate income tax return filing date, filed with the Register of Companies.
  • Latest annual accounts filed with the Register of Companies.

If none of the above options is fulfilled, both legal persons and sole traders can prove their financial capacity by means of the following:

  • Certificate from a financial or insurance entity amounting to a guarantee that the entity will jointly and severally act as guarantor for the undertaking for claims by its creditors up to the appropriate amount.
  • Certificate from a financial institution attesting that the undertaking has access to credit up to the corresponding amount.

The transport operator:
An ex officio check will be carried out in the Social Security register to ensure that the proposed operator meets the necessary connecting criteria.

If the permit holder is a natural person:
If the proposed operator is the spouse of the permit holder or has a family relationship of consanguinity, affinity or adoption with them up to the second degree, in accordance with the standards applicable to the matter, they must prove this by means of a family register, public deed or tax or administrative documentation stating the relationship. In this case, the Directorate-General will consult their entry in the relevant social security scheme.

If the permit holder is a legal person:
If the proposed operator is not registered as a managerial staff member in the corresponding full-time General Social Security Scheme, in a contribution group not lower than that of the administrative and workshop managers (groups 1, 2 or 3), the undertaking must prove that the operator holds at least 15 % of the undertaking’s share capital. In this case, the Directorate-General will consult their entry in the relevant social security scheme.

If the transport operator wishes to perform this role in several companies at the same time, it will be necessary to submit a document proving that the same holder holds more than 50 % of the capital of each undertaking.

Requirements
  1. The holder of the permit must be a national of a Member State of the European Union, of the European Economic Area or of any other country whose citizens and their family members are eligible for the scheme. Proof of the tax identification number is required.
    If the nationality of the permit holder is not as described above, evidence must be provided of holding long-term residence or temporary residence and a work permit and, as in the previous case, of holding the relevant tax identification number, which must be valid and not have been revoked.
  2. If the applicant is not a natural person, the legal person holding the permit must:
    • Have its own legal personality, independent of its members.
    • Be registered in the appropriate public register.
    • Be for-profit.
    • Expressly state that its corporate purpose is the provision of public passenger transport by bus.
  3. The permit holder must have an address in Spain where the documents relating to its management and operation are kept at the disposal of the Land Transport Inspection Services.
  4. In order to comply with the requirement of professional competence, proof must be provided that the undertaking has a natural person who performs the functions of transport operator in its permanent employ. This operator must hold a certificate issued by the Administration attesting to their professional competence for road passenger transport.
    • Duties:
      • The transport operator will be required to effectively and continuously manage the transport activities of the undertaking. The duties they must perform are regulated in Article 112 of the Regulation of the Law on the organisation of land transport.
    • Connecting factor:
      1. If the holder is a natural person:
        • If the holder is also the transport operator, they must be registered with the relevant social security scheme.
        • If the holder is not the transport operator, the operator must be registered as a managerial staff member in the corresponding full-time General Social Security Scheme, in a contribution group not lower than that of administrative and workshop managers – groups 1, 2 or 3.
      2. If the holder is a legal person:
        • The transport operator must:
          • be registered as a managerial staff member in the corresponding General Social Security Scheme, in a contribution group not lower than that of administrative and workshop managers – groups 1, 2 or 3 –, or
          • hold at least 15 % of the undertaking's share capital and be registered with the relevant social security scheme.
  5. The permit holder and the transport operator of the undertaking must meet the requirement of good repute.
  6. Financial capacity: the holder must have at their disposal capital of EUR 9 000 for the first vehicle and an additional EUR 5 000 for each additional vehicle.
  7. Compliance with tax obligations. Requirements:
    • To be entered in the taxpayers’ register under the section on road passenger transport (721.3).
    • Not to have outstanding debts with the State or with an autonomous community.
  8. To comply with labour and social obligations. Requirements:
    • The undertaking must be registered with the Social Security in the corresponding scheme.
    • To be up to date with the payment of contributions or other debts to the Social Security.
  9. To have at least one vehicle under a system of ownership, lease or ordinary rental, which is no more than two years old from the date of first registration.
  10. Not to have any registered or deregistered VD or VPC permits that can be reinstated.
  11. Not to have outstanding penalties for infringements of transport legislation imposed by a final ruling in an administrative procedure.
  12. To have an electronic signature and the computer equipment needed to document the contracts and other business formalities with customers remotely. It will be necessary to provide an email address that will be used to officially finalise and document transport contracts with customers.
  13. To pay the corresponding fee.
