What do you need to know?

This procedure may be requested at any time.
- For assignment, if the transport operator is not an external worker, evidence must be provided of:
- a connection with the undertaking: holding at least 15 % of the shares in the undertaking and also being a self-employed person; or
- a connection with the holder (natural person): as a collaborating family member.
- For de-assignment, no documentation is required.
- In order to meet the requirement of professional competence, it must be established that the undertaking has a natural person performing the functions of transport operator in its permanent employ. They must hold a certificate issued by the administration attesting to their professional competence in the field of goods transport by road.
- Duties:
- It will be necessary for the transport operator to comply with the requirement regarding effective and permanent management of the transport activities of the undertaking. The tasks to be performed by the transport operator are governed by Article 112 of the Regulation of the Law on the Organisation of Land Transport.

- If the holder is a natural person:
- Where the holder is also the transport operator, they must be registered in the relevant social security scheme.
- If the holder is not the transport operator, the operator must be registered as managerial staff in the relevant general social security scheme, on a full-time basis, in a contribution group not lower than that of the administrative and workshop managers – Groups 1, 2 or 3.
- If the holder is a legal person:
- The operator must be registered as managerial staff in the relevant general social security scheme, on a full-time basis, in a contribution group no less than that of the administrative and workshop managers – Groups 1, 2 or 3.
- The operator must hold at least 15 % of the undertaking’s share capital and must be registered with the relevant social security scheme.
