What do you need to know?
The Register of Real Estate Agents of Catalonia is public, administrative in nature and mandatory.
Registration:
Grants the status of an approved real estate agent and gives the right to make this status public.
It allows proof that the person listed in the Register meets the requirements and conditions appropriate to carry out the activity.
Real estate agents are natural or legal persons who are regularly and remunerated in providing mediation, advisory and management services in real estate transactions in relation to the purchase, sale, rental, exchange or transfer of real estate and the corresponding rights, including the constitution of these rights (article 55 of Law 18/2007, of 28 December, on the right to housing).
The purpose of this Register is to promote transparency in the housing sector and guarantee consumer protection. It guarantees citizens that the real estate agent is capable of providing an efficient and quality service, as it certifies that they have relevant academic training, experience in the field in which they work and financial solvency.

To natural or legal persons who wish to practice as real estate agents established in Catalonia.
The following natural or legal persons do not have to register in this register:
- Property administrators who exclusively carry out the activities regulated in article 54 of Law 18/2007, of 28 December, on the right to housing.
- Real estate agents who act in Catalonia on a regular basis from a state of the European Union or from outside Catalonia, without an establishment open to the public in this territorial area (Catalonia).
- People who act in Catalonia on a non-regular basis and without remuneration in the provision of services related to real estate transactions, according to the provisions of Law 18/2007, of 28 December, on the right to housing.
It can be requested at any time. The transitional period for agents who were carrying out real estate mediation activities on March 10, 2010 ended after six months.
In case of applications submitted individually
Documentation to be attached to the registration application / responsible declaration:
- Civil liability insurance policy
- Guarantee (insurance of surety or bond subscribed)
- Proof of professional training: university degree or certificates of knowledge in real estate
In the case of applications submitted collectively through a professional association or professional association
It is not necessary to attach documentation to the application. The collective declaration states that all members or associates meet the established conditions and requirements and that they are duly covered by the civil liability policy and the guarantee provided for in the regulations.
In the case of in-person presentation, for registrations of legal entities, it is also necessary to provide the accreditation of the person signing the application for registration in the register as the appropriate representative of the company, that is, the articles of incorporation where the person signing appears as administrator or authorized representative.
Location and service requirements
- Real estate agents must have an establishment open to the public, unless the services are provided remotely by electronic or telematic means. Establishments open to the public include professional residences, commercial premises and offices or offices that meet all the requirements and have the permits, licenses and tax registrations legally required to carry out the activity.

- Real estate agents must be professionally trained to carry out the activity. Professional training must be accredited in one of the following ways:

- With a related university degree:
- Real estate agents must comply with the obligations and principles of action established in current legislation and in professional codes of conduct.
- In the case of legal entities, the two previous requirements must be met by the administrators or, where applicable, the members of the board of directors of the company, as well as the person responsible for each establishment open to the public.
Solvency requirements
- A civil liability insurance policy in force for the entire time the activity is carried out, which guarantees the damages and losses that may be caused during the exercise of its activity for a minimum insured capital of:
- 100,000 euros per claim and 600,000 euros per year and per establishment open to the public in Catalonia
- 150,000 euros per claim and 1,000,000 euros per year in the event of carrying out the activity through electronic or telematic means
- A guarantee: surety or bond insurance taken out with a duly authorized insurance or financial entity, according to its specific regulations. The minimum amount per year of coverage is:
- 60,000 euros per establishment open to the public in Catalonia
- 300,000 euros per agent if the real estate agent carries out his activity exclusively through electronic or telematic means
(The guarantee is executed by express agreement between the recipients of the amounts received and the persons who delivered them, or by virtue of a court judgment, final arbitration award or final administrative resolution that rules on the rights of the persons interested in the aforementioned amounts.)
Visual identification requirements
Once registered, the agent undertakes to use the badge that grants him the status of real estate agent approved by the Generalitat de Catalunya and that certifies and guarantees to the public that he meets the requirements and conditions appropriate to exercise the activity of real estate agent. The mandatory badge contains a unique number. The badge must be used at least:
- as a plaque, in a place visible to the public
- on stationery (there is a visual identity manual for registered agents)
- on any type of advertising carried out by the agent
There are no fees associated with this procedure.
The Register is assigned to the department responsible for housing, and depends on the Secretariat of Housing and Urban Improvement, which is responsible for it. The Register is managed by the Catalan Housing Agency.

Changes and modifications
Once registered, the agent must update the data provided when any modification occurs. In this case, the holder must provide, individually or through the professional association or association, a responsible declaration specifying the changes that have occurred.
Modifications to the data in the Register will be processed using the same registration procedure, as will the temporary suspension and cancellation of registration at the request of an interested party.

In order to make the registration in the Register effective, the managing entities will carry out the checks they deem appropriate of the documentation declared or provided regarding compliance with the requirements, guarantees and insurance for the exercise of the activity.
Regardless of the way in which the applications are submitted, the registration is carried out individually for each agent.What response is received?
In response to the application, if the requirements are met, the Administration registers the person in the Register of Real Estate Agents (Registered Agents) and grants the right to use the real estate agent plate approved by the Generalitat de Catalunya (Characteristics of the badge and visual manual), without this necessarily implying any responsibility on the part of the Generalitat de Catalunya in relation to the actions of the agents.
The registration is indefinite, although at the request of a party, through the same procedure as the registration, the temporary suspension or cancellation of the registration can be obtained. Temporary suspension can also occur due to the disqualification of the agent as a result of a sanctioning resolution provided for in article 116 of Law 18/2007, of 28 December, on the right to housing, agreed by the competent body in sanctioning matters. Finally, the death of the registered person or the failure to comply with the registration requirements, after hearing the interested parties, means the cancellation of the registration, which gives rise to the removal from the Register of Real Estate Agents of Catalonia.
