What do you need to know?
Archaeological or palaeontological interventions are classified as those that form part of a research project. This is assessed by a scientific institute or museum, one of whose objectives is research into an aspect of archaeology or palaeontology that is related to the project’s objective.
Authority responsible
Any individual or corporate entity (public or private) able to prove that the intervention forms part of a research project that meets the requirements of current legislation.
The application shall be submitted at least two months prior to the start date for the work.
Documentation to be included with the application:
- The research project of which the intervention is part or from which it derives, specifying its duration, how it will be supplied and its objectives.
- A report, including the description of the area in which the intervention is taking place and its exact location, giving its coordinates and marking it on a map. If the intervention is to take place under water, the depth of the site and the characteristics of the seabed.
- The detailed programme of jobs to be carried out, which shall clearly state the methodology and techniques to be employed, the material means, the length of time the project will necessitate, the number of people who will work on it, the infrastructure for studying the materials and all the information that will contribute to the realisation of the project. In the case of excavation projects, the programme for consolidation, preservation or treatment of remains shall be submitted. In the case of underwater interventions, the specific treatment that the remains are to receive immediately following removal from their environment shall be specified.
- A detailed budget for the intervention, indicating the intended sources of financing. This budget shall include expenditure relating to the consolidation and preservation of the site and, where necessary, to the backfill. In the case of interventions that involve the possible removal of remains, provision shall be made for financing their transportation and consolidation.
- The qualifications, and other personal and professional data of the person or persons who will be in charge of the intervention, and their written authorisation if is not they who are applying for authorisation.
- Documentation accrediting the authorisation of the owner and those with any form of right to the site on which the intervention is to take place. The authorisation shall indicate the period for which authorisation is granted.
The intervention shall form part of a research project that is judged to be such by a scientific institute or museum, one of whose objectives is research into an aspect of archaeology or palaeontology that is related to the project's objective.
Applicants shall have the necessary financial, personal, technical and infrastructural means to run the intervention and handle any remains that are found, pursuant to the Regulations for the Protection of Archaeological and Palaeontological Heritage.
The amount of the fee for processing the application is 21,85 euros.
The Directorate-General for Cultural Heritage's Archaeology and Palaeontology Service examines the submitted application, requests the undertaking of any clarifications that may be necessary and makes a proposed decision using the prior report of the Archaeology and Palaeontology Service's Advisory Committee.
Archaeological and palaeontological interventions require authorisation from the Director-General of Cultural Heritage and the local authorities of affected municipalities are informed of such authorisation at the same time as the interested party.

How and when will the applicant be notified of the decision?
The Director-General of Cultural Heritage reaches a decision on applications to authorise archaeological and palaeontological interventions within two months. Where express notice is not given, the application shall be understood to have been rejected.
